This Privacy Policy explains how Fuel Me, LLC (“Fuel Me”, “we”, “us”, or “our”) collects, uses, discloses, and protects your information when you use our Service. It also describes your privacy rights and how the law protects you. Section 8 sets out the terms that govern our SMS/text messaging program and the handling of Mobile Information.

By using our Service, you agree to the collection and use of information in accordance with this policy. If you do not agree, please do not use the Service.

1. Interpretation and Definitions

*Interpretation.** Words with capitalized initials have meanings defined under the conditions below. These definitions apply regardless of singular or plural use.

*Definitions:*

  • Account: A unique profile to access our Service.
  • Affiliate: Entities related by ownership or control.
  • Application: The Fuel Me mobile app.
  • Business (CCPA/CPRA): Refers to Fuel Me, LLC operating in California.
  • Company: Fuel Me, LLC, 150 Harvester Dr., Suite 140, Burr Ridge, IL 60527.
  • Consumer: A resident of a U.S. state with applicable privacy laws (e.g., California, Virginia, Colorado, Connecticut, Texas, Utah).
  • Cookies: Small data files stored on your device.
  • Country: United States (Illinois).
  • Device: Any internet-connected device.
  • Do Not Track (DNT): A browser setting to opt out of tracking across websites.
  • Mobile Information: Mobile phone numbers, SMS/text messaging opt-in data, consent records, and message history collected through our SMS Program.
  • Personal Data / Personal Information: Information that identifies, relates to, or could reasonably be linked with an individual.
  • Sale / Sharing: Disclosing personal information to a third party for monetary or other valuable consideration, or for cross-context behavioral advertising, as defined by applicable law.
  • Service: The Website and/or Application.
  • Service Provider / Processor: A third party that processes data on our behalf under contract.
  • SMS Program: Fuel Me’s text messaging program described in Section 8.
  • Third-Party Social Media Service: External platforms used to log in.
  • Usage Data: Data collected automatically from your use of the Service.

  • You: The user or entity using the Service.

2. Collecting and Using Your Personal Data

a. Categories of Data Collected

*Personal Data you provide.** We may collect your:

  • Email address
  • First and last name
  • Phone number, including mobile phone number if you opt in to our SMS Program
  • Mailing/business address
  • Company, role, and account details
  • Payment and billing information (processed by our payment processor; we do not store full card numbers)
  • Communications you send us (support requests, form submissions, inquiries)

*Usage Data, collected automatically.** May include:

  • IP address
  • Browser type and device information
  • Pages viewed and time spent on pages
  • Diagnostic and log data

*Data from mobile devices, with your permission.** May include:

  • Device type and ID
  • Approximate or precise location data
  • Contacts (only with permission)
  • Camera/photos (only with permission)

You can manage cookies through your browser settings and, where available, through our cookie preferences tool. Mobile Information is never used for advertising or shared via advertising cookies.

3. How We Use Your Personal Data

We use your data to:

  • Provide, operate, and maintain the Service
  • Create and manage your Account
  • Fulfill contractual obligations and complete fuel orders
  • Process payments and prevent fraud
  • Communicate service updates, follow-ups, offers, and account notices by email, phone, or, with your consent, text message
  • Respond to your requests and provide support
  • Comply with legal obligations and enforce our terms
  • Improve and analyze the Service

We rely on the following legal bases where applicable: performance of a contract, your consent, our legitimate business interests, and compliance with legal obligations.

4. How We Disclose Personal Data

We may disclose Personal Data to:

  • Service Providers / Processors who perform services for us (analytics, email, payment processing, hosting, advertising) under contracts that limit their use of the data.
  • Affiliates and business partners, consistent with this policy.
  • Other users, only where you choose to interact publicly.
  • Authorities or third parties to comply with law, respond to legal process, or protect rights, property, or safety.
  • Acquirers in connection with a merger, acquisition, financing, or sale of assets.

*Mobile Information carve-out (controls over all of the above). Notwithstanding anything else in this policy, no Mobile Information will be shared with or sold to third parties or affiliates for their marketing or promotional purposes. All of the categories of information sharing stated in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.** See Section 8.

We do not sell your Personal Information or share it for cross-context behavioral advertising in exchange for money, and we never sell, rent, lease, or share Mobile Information.

5. Retention of Data

We retain Personal Data only as long as necessary for the purposes described in this policy or as required to comply with legal, accounting, or reporting obligations. As general guidance: account data is retained for the life of your account plus up to seven (7) years for tax and audit purposes; SMS consent and opt-out records are retained for at least four (4) years to demonstrate compliance; usage and log data is typically retained for up to twenty-four (24) months. When data is no longer needed, we delete or de-identify it.

6. Data Transfers and Security

Your information may be transferred to and maintained on systems located outside your state or country. We use commercially reasonable administrative, technical, and physical safeguards to protect your data, including encryption in transit and access controls. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security. If we become aware of a breach affecting your Personal Data, we will notify you and regulators as required by law.

7. Children’s Privacy

Our Service is intended for business use and is not directed to anyone under 18. We do not knowingly collect Personal Data from children under 13. If you believe a child has provided us Personal Data, contact us at support@fuel.me and we will delete it. Under California law, minors under 18 who are registered users may request removal of content they posted.

8. SMS / Text Messaging Privacy and Terms

This section describes our SMS Program and the special protections that apply to Mobile Information. It is written to comply with the CTIA Messaging Principles and Best Practices (including Section 5.2.1) and applicable telecommunications and privacy laws.

a. Program Description

Fuel Me is a B2B fuel procurement platform that coordinates on-site fuel deliveries (diesel, gasoline, DEF, lubricants) for commercial fleets, construction sites, and marine operations across the U.S., connecting customers with a vetted network of fuel vendors and managing the order lifecycle from dispatch through invoicing. Our SMS Program supports this workflow and, where you separately consent, also delivers marketing communications.

b. Who Receives Messages

We send messages only to opted-in audiences with an active business relationship with Fuel Me:

  • Commercial customers (account owners, dispatchers, site managers, AP contacts) who provided their mobile number during account setup or via a consent form on our Website.
  • Vendors who provided their mobile number during vendor onboarding.

c. Types of Messages and Consent

Fuel Me may send:

  • Transactional and operational messages (including satisfaction surveys): order and delivery confirmations, delivery status and updates, operational notices (office closures, holidays, weather disruptions), two-factor authentication codes, satisfaction surveys, and follow-ups about your inquiry or account. By providing your mobile number during account setup, vendor onboarding, or otherwise in the course of your business relationship with us, you consent to receive these transactional, operational, and survey messages.
  • Marketing and promotional messages: offers, product news, and updates about Fuel Me services. These require your separate, affirmative opt-in (for example, an optional, unchecked-by-default checkbox during portal account setup or on a web form).

Marketing consent is collected separately from transactional consent and is never bundled into account creation. Consent to receive any SMS messages is not a condition of purchasing any goods or services from Fuel Me, and marketing consent is not a condition of creating or using your account.

d. Privacy of Mobile Information (CTIA 5.2.1)

The following terms apply specifically to Mobile Information and supplement the protections elsewhere in this policy:

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the categories of information sharing stated in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. End users can opt out of receiving further messages by replying STOP, or ask for more information by replying HELP. Message frequency may vary. Message and data rates may apply.

We share limited information with service providers and subcontractors only as needed to operate the SMS Program and fulfill the underlying service (for example, our SMS platform provider and the fuel vendor fulfilling your order). We do not sell, rent, lease, or otherwise share mobile phone numbers, opt-in data, or SMS consent records with any third party for that party’s own marketing or commercial use.

e. Opt-Out, Help, Frequency, and Rates

  • Opt out at any time by replying STOP to any message. You will receive one final confirmation, and no further messages will be sent unless you re-subscribe.
  • Reply HELP for help, or contact support@fuel.me.
  • Message frequency varies based on account activity.
  • Message and data rates may apply based on your wireless carrier’s plan. Fuel Me is not responsible for carrier charges.

f. SMS Consent Disclosure for Web Forms

Where we collect SMS consent through a web form, you will see a disclosure substantially similar to the following, with an optional, unchecked-by-default checkbox. The form can be submitted whether or not the box is checked:

9. Third-Party Services

  • Analytics: Google Analytics may track Website usage and share it with other Google services.
  • Advertising: Google AdSense/DoubleClick may show personalized ads.
  • Email marketing: We may send promotional emails via third-party providers.
  • Payments: Processed via Compass Payment Services; we do not store full card details.
  • Remarketing: Google Ads may show ads based on your prior activity.

None of these third-party services receive Mobile Information for their own purposes (see Section 8.d).

10. Your Privacy Rights

Depending on where you live, you may have some or all of the following rights regarding your Personal Information:

  • Right to know / access the categories and specific pieces of Personal Information we collect, use, and disclose.
  • Right to correct inaccurate Personal Information.
  • Right to delete Personal Information we hold about you.
  • Right to opt out of the sale or sharing of Personal Information and of targeted advertising.
  • Right to data portability in a usable format.
  • Right to limit use of sensitive Personal Information.
  • Right to non-discrimination for exercising your rights.
  • Right to appeal a denial of your request, where provided by law.

*How to exercise your rights.** Submit a request by emailing support@fuel.me, using the “Do Not Sell or Share My Personal Information” link on our Website, or calling (833) 838-3563. We will verify your identity before responding. You may use an authorized agent to submit a request on your behalf with proof of authorization. We will respond within the timeframe required by applicable law (generally 45 days, extendable where permitted).

a. California (CCPA/CPRA)

California residents have the rights listed above. In the preceding 12 months we may have collected the following categories: identifiers (name, email, phone, address, IP), commercial information (orders, billing), internet/network activity (usage data), geolocation data, and professional/employment information. We do not sell Personal Information, and we never sell or share Mobile Information. Under California’s “Shine the Light” law, you may request information about disclosures to third parties for their direct marketing.

b. Other U.S. States

Residents of Virginia, Colorado, Connecticut, Texas, Utah, and other states with comprehensive privacy laws have rights to access, correct, delete, and obtain a copy of their Personal Data, and to opt out of targeted advertising and the sale of Personal Data. To exercise these rights, use the methods in this Section.

c. EU/UK Residents (GDPR)

If you are in the EEA or UK, you have rights to access, rectify, erase, restrict, and object to processing of your Personal Data, and to data portability. Our legal bases are described in Section 3. You may lodge a complaint with your local supervisory authority. Where we transfer data internationally, we use appropriate safeguards such as Standard Contractual Clauses.

11. “Do Not Track” and Cookie Choices

Our Service does not currently respond to DNT browser signals. We honor recognized opt-out preference signals (such as Global Privacy Control) where required by law. You can control cookies through your browser settings.

12. Links to Other Websites

Our Service may contain links to third-party websites. We are not responsible for their content or privacy practices, and we encourage you to review their policies.

13. Changes to This Policy

We may update this Privacy Policy periodically. The “Last updated” date reflects the most recent revision. We will notify you of material changes by email or a prominent notice on the Service. Material changes to how we handle Mobile Information will be communicated before they take effect.
